These Terms of Use ("Terms") govern your use of aacgroup.com.my, our dealer portal and download center (together, the "Website"), operated by AAC Distribution Sdn Bhd ("AAC", "we", "us" or "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website. Under the Electronic Commerce Act 2006, your agreement given electronically is as valid as a written agreement.
1. Who may use the Website
The Website is intended for businesses, dealers, installers and adult members of the public in Malaysia. If you use the Website on behalf of a company, you confirm that you are authorized to accept these Terms for that company.
2. Acceptable use
You agree to use the Website only for lawful purposes. You must not:
- Access, or try to access, any part of the Website, our servers or systems without authorization, which is an offense under the Computer Crimes Act 1997.
- Upload or send viruses, malware or any harmful code, or interfere with the Website's security or performance.
- Use bots, scrapers or other automated tools to copy content, prices or product data from the Website.
- Submit false, misleading or spam enquiries, or impersonate any person or company.
- Use the Website in any way that breaks Malaysian law or infringes the rights of others.
3. Dealer accounts
- Dealer accounts are available to approved business customers only. We may approve, decline, suspend or close any account at our discretion, including if these Terms are breached.
- You must give accurate information when registering and keep it up to date through the Account Information page.
- You are responsible for keeping your username and password confidential and for all activity under your account. Tell us immediately if you suspect unauthorized use.
- Accounts are for the named business only and must not be shared with, sold or transferred to anyone else.
4. Dealer pricing and confidential information
Dealer price lists, promotions, project pricing and other information in the dealer portal are confidential and provided only for your own business use as an AAC dealer. You must not publish, forward or share them with end customers, competitors or any third party, including on websites, marketplaces or social media. We may suspend or close your account, and take further action, if this information is disclosed without our permission.
5. Product information, prices and availability
We try to keep product information accurate and up to date, but specifications, images, models, prices and availability may change without notice, often because the manufacturer changes them. Product images are for illustration only. Unless stated otherwise, prices shown are indicative and exclude applicable taxes, delivery and installation.
Information on the Website is not an offer to sell. A sale is only confirmed by our written quotation, order confirmation or invoice, which will set out the final price and terms. If we find an error in a price or description, we may correct it and cancel or amend any affected order before it is fulfilled.
6. Orders, delivery and warranty
Purchases from AAC are governed by the terms in our quotation, order confirmation and invoice, and purchases on store.aacgroup.com.my are governed by the terms shown on that store. Products are covered by the manufacturer's warranty and AAC's warranty policy for each brand, as provided at the time of purchase. Warranty does not cover damage caused by incorrect installation, misuse, power surges, accidents or unauthorized repair or modification.
7. Download center
Firmware, software, tools and manuals in our download center are provided by the respective manufacturers for use with their products. They are provided "as is", and you use them at your own risk. Always follow the manufacturer's instructions, check that a file matches your exact model and region, and back up configurations before updating firmware. We are not responsible for devices damaged or made unusable by an incorrect or interrupted update. Your use of any software is also subject to the manufacturer's own license terms. Access codes for the download center are confidential and must not be shared.
8. Intellectual property
The content on the Website, including text, layout, graphics, photos and the AAC name and logo, belongs to AAC or our licensors and is protected under the Copyright Act 1987 and the Trade Marks Act 2019. You may view and print pages for your own business or personal reference only. You must not copy, republish, modify or use our content for commercial purposes without our written permission.
Hikvision, Hanwha Vision, Ruijie Reyee, EZVIZ, TP-Link, APC, Belden, i-PRO and other brand names, logos and product images are trademarks of their respective owners and are used on the Website to identify products we distribute. Their use does not grant you any rights in them.
9. Third-party links and content
The Website may link to or embed content from third parties, such as manufacturer websites, Google Maps, YouTube, WhatsApp and social media. We do not control and are not responsible for their content, availability or privacy practices. Your use of them is at your own risk and subject to their terms.
10. Disclaimer
The Website and its content are provided on an "as is" and "as available" basis for general information. To the extent permitted by law, we do not guarantee that the Website will be uninterrupted, error-free or free of viruses, or that its content is complete, accurate or suitable for any particular project. Technical information and solution designs on the Website are a general guide and do not replace a site survey or professional advice.
11. Limitation of liability
To the extent permitted by law, AAC and its directors, employees and agents will not be liable for any indirect, incidental or consequential loss, or for any loss of profit, revenue, data or business, arising from your use of, or inability to use, the Website or its content.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Malaysian law. If you are a consumer, nothing in these Terms affects your rights under the Consumer Protection Act 1999 or the Sale of Goods Act 1957.
12. Indemnity
You agree to compensate AAC for any loss, damage, cost or claim (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your unauthorized disclosure of dealer pricing or other confidential information.
13. Privacy
We collect and use personal data in line with our Privacy Policy and the Personal Data Protection Act 2010.
14. Changes to the Website and these Terms
We may update, suspend or remove any part of the Website at any time. We may also update these Terms from time to time, and the latest version will be posted on this page with the "Last updated" date. Your continued use of the Website after changes are posted means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of Malaysia. If a dispute arises, we encourage you to contact us first so we can try to resolve it amicably. If it cannot be resolved, it will be subject to the exclusive jurisdiction of the courts of Malaysia.
16. General
If any part of these Terms is found to be invalid or unenforceable, the rest will remain in full effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any written quotation or invoice, form the entire agreement between you and AAC about your use of the Website.
